Please read these Terms and Conditions carefully before using Speakly. By downloading, installing, accessing, subscribing to, or using the app, you agree to be bound by these Terms. If you do not agree, you should not use the app.

1. Acceptance of Terms

These Terms and Conditions govern your use of Speakly / SpeaklyApp, including all features, content, tools, subscriptions, and services made available through the app.

By using Speakly, you confirm that you have read, understood, and accepted these Terms, together with the Privacy Policy. If you use Speakly on behalf of another person, organization, or business, you confirm that you have authority to accept these Terms on their behalf.

2. Description of the Service

Speakly is a translation application designed to help users communicate more easily across languages. The app may include text translation, voice translation, speech-to-text, text-to-speech, camera translation, photo translation, real-time conversation translation, offline translation features, downloaded language resources, translation history, voice settings, and account-based features.

Some features may require an internet connection, a compatible device, supported languages, active permissions, or an active subscription. Some features may not be available in every country, language, device, operating system, or version of the app.

3. Eligibility

You must be old enough to use digital services under the laws of your country or have permission from a parent or legal guardian. You agree to use Speakly only for lawful purposes and in accordance with these Terms.

4. Account and Sign-In

Speakly may allow you to sign in through supported authentication providers, such as Google Sign-In, Apple Sign-In if enabled, Firebase Authentication, or other supported methods.

You are responsible for maintaining the confidentiality and security of your account. You are also responsible for all activity that occurs under your account. We may restrict, suspend, or terminate access if we reasonably believe that your account has been misused, compromised, used to violate these Terms, or used in a way that may harm the app, other users, or third parties.

5. Free Plan and Pro Plan

Speakly may provide both free and paid plans. The Free plan provides limited access to selected app features. The Pro plan provides higher usage quotas and may unlock additional features. The actual features and limits may change over time depending on technical availability, app updates, infrastructure cost, third-party service availability, and business requirements.

6. Current Usage Quotas

The following quotas are currently intended for Speakly. These limits may be adjusted in future versions of the app. If you reach a quota limit, the app may restrict the relevant feature until the quota resets, offer an upgrade option, or temporarily disable the relevant function. Quotas may be enforced locally, through cloud systems, through account data, or through subscription entitlement systems.

7. Subscriptions, Billing, and Renewal

Paid subscriptions may be offered weekly, every two weeks, monthly, every three months, yearly, or through other plan types made available in the app. Payments may be processed through Apple App Store, Google Play, RevenueCat, or another authorized payment or subscription provider. Speakly does not directly store your full payment card details.

Subscription prices, billing intervals, free trials, renewals, cancellations, taxes, and refunds are governed by the applicable app store or payment provider. The final price and billing terms will be shown before purchase. Subscriptions may renew automatically unless cancelled before the renewal date through the relevant App Store or Google Play account settings. Deleting the app does not automatically cancel a subscription. Refunds, where available, are handled according to the policies of Apple, Google, or the relevant payment provider.

8. Free Trials and Promotions

Speakly may offer free trials, discounts, introductory pricing, or promotional offers. Eligibility and duration may vary by country, user status, device, platform, or campaign. If a free trial converts into a paid subscription, you may be charged automatically unless you cancel before the trial ends according to the applicable app store rules.

9. Translation Accuracy and Important Use

Speakly is intended to assist communication, but translations may not always be accurate, complete, culturally appropriate, or suitable for every context. Errors may occur due to accent, background noise, unclear speech, image quality, lighting, handwriting, ambiguous words, idioms, slang, dialects, technical limitations, connectivity issues, or third-party service limitations.

You should not rely solely on Speakly for high-risk or professional matters, including medical, legal, financial, immigration, safety-critical, contractual, emergency, or government-related communication. You are responsible for reviewing and verifying translations before using them in important situations.

10. Camera, Microphone, Photo Library, and Speech Recognition

Certain features require device permissions. Microphone access may be used for voice translation and speech-to-text. Speech recognition may be used to convert spoken words into text. Camera access may be used to translate text from captured images. Photo library access may be used to select images for translation or profile-related features if available.

You can manage permissions in your device settings. If permissions are disabled, related features may not work.

11. Offline Mode and Downloaded Languages

Speakly may provide offline translation, cached translation, or downloaded language resources. Offline mode may have lower accuracy, fewer supported languages, or fewer supported features than online mode. When an internet connection is available, the app may automatically use online services such as Azure or Google translation-related services if they provide better performance or availability. Downloaded languages and offline data may use storage space on your device. You may be able to remove downloaded languages or offline data from within the app or device settings.

12. User Content

You retain ownership of the text, voice, images, translations, and other content that you submit to Speakly. However, you grant Speakly and its service providers permission to process that content as necessary to provide app features, including translation, speech recognition, text recognition, text-to-speech, history, quota management, support, and debugging.

You are responsible for the content you submit. You must not use Speakly to process or distribute unlawful, harmful, abusive, infringing, misleading, fraudulent, private, stolen, or otherwise prohibited content.

13. Translation History and Stored Data

Speakly may store translation history, preferences, downloaded languages, cached translation results, quota usage, and app settings locally on your device and may also sync certain account-related data through cloud services when cloud sync is enabled. You may be able to clear history, remove downloaded languages, sign out, or delete account data depending on the features available in the app.

14. Prohibited Conduct

  • Attempting to bypass quotas, subscriptions, or entitlement checks.
  • Using bots or scripts to generate excessive usage.
  • Reverse engineering or modifying the app.
  • Attacking, disrupting, or overloading systems.
  • Accessing APIs or backend systems without authorization.
  • Using the app for illegal activity or violating the rights, privacy, or safety of others.

15. Intellectual Property

Speakly, including its name, logo, design, user interface, text, graphics, animations, software, code, features, and related materials, is owned by Nattapong Takul or licensed to the app owner. You receive a limited, personal, non-exclusive, non-transferable, revocable license to use the app in accordance with these Terms. You may not copy, sell, rent, sublicense, modify, distribute, or exploit any part of Speakly without permission.

16. Third-Party Services

Speakly may use third-party services and SDKs, including Azure, Google services, Firebase Analytics, Firebase Crashlytics, Firebase Authentication, RevenueCat, Apple App Store, Google Play, speech recognition services, text recognition services, translation services, cloud services, and other infrastructure providers. Third-party services may have their own terms and privacy policies. Speakly is not responsible for the availability, changes, errors, downtime, policies, or actions of third-party services.

17. Updates and Changes to the App

We may update, modify, add, remove, suspend, or discontinue any feature, plan, quota, language, integration, or service at any time. Changes may be made for security, reliability, cost, legal, business, technical, or platform-compliance reasons.

18. Disclaimer of Warranties

Speakly is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of accuracy, reliability, availability, fitness for a particular purpose, non-infringement, and uninterrupted operation.

19. Limitation of Liability

To the maximum extent permitted by law, Nattapong Takul and Speakly will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, loss of profit, failed communication, inaccurate translation, service interruption, subscription issues, or inability to use the app. Nothing in these Terms limits liability where such limitation is not permitted by applicable law.

20. Suspension and Termination

We may suspend, restrict, or terminate your access to Speakly if you violate these Terms, misuse the service, create security risks, attempt to bypass limits or payments, or use the app in a way that may harm users, third parties, or the app. You may stop using the app at any time. If account deletion is available, you may request deletion through the app or contact channel.

21. Account Deletion

Deleting your account may remove or disable access to profile data, settings, cloud-synced history, and account-related features. Some information may be retained where necessary for legal, billing, fraud-prevention, security, dispute-resolution, or operational reasons. Deleting an account does not automatically cancel an active subscription. Subscriptions must be cancelled through Apple App Store or Google Play account settings.

22. Governing Law and Disputes

These Terms are governed by the laws of Thailand, without regard to conflict-of-law principles. Any dispute will be handled under the applicable laws and courts or authorities of Thailand, unless mandatory consumer-protection laws in your country require otherwise.

23. Changes to These Terms

We may update these Terms from time to time. If changes are significant, we may notify you through the app, website, email, or other reasonable means. Continued use of Speakly after the effective date of updated Terms means you accept the updated Terms.

1. Overview

Speakly is a translation app that may process text, voice, images, language settings, translation history, usage quotas, account data, subscription data, and technical data to provide translation and communication features. The app may store some data locally on your device and may also sync certain data through cloud services when account or cloud sync features are enabled.

3. Information We May Collect or Process

3.1 Account Information

Name, email address, profile photo, user ID, sign-in provider, account status, and account settings may be collected when you sign in or create an account. This data is used for authentication, account access, synchronization, support, and account management.

3.2 Translation Content

Speakly may process text you type, voice converted into text, images you capture or select, text detected from images, source language, target language, translation results, and conversation content. This data is used to provide translation, speech recognition, text recognition, and related app features.

3.3 Voice and Audio Data

When you use voice features, Speakly may access your microphone and process audio to convert speech into text. Processing may occur on your device, through operating-system services, or through third-party services depending on the feature and platform.

3.4 Camera and Photo Data

When you use camera or photo translation, Speakly may process captured photos, selected images, text detected from images, and related translation results. The app requests camera or photo library permission before using these features.

3.5 Translation History

Speakly may store translation history, including original text, translated text, languages, date and time, and feature type. History may be stored locally and may be synced through cloud services if cloud sync is enabled.

3.6 Usage, Quota, and Plan Data

Speakly may process the number of text, voice, photo, and real-time translation uses; remaining quota; reset times; plan type; subscription status; and feature access. This data is used to enforce Free and Pro limits, prevent abuse, manage costs, and show upgrade options.

3.7 Subscription and Purchase Data

If you subscribe, Speakly or its providers may process product ID, entitlement status, subscription status, renewal status, purchase date, expiration date, trial status, transaction identifiers, and receipt validation data. Full payment card information is handled by Apple, Google, or payment providers and is not directly stored by Speakly.

3.8 Device and Technical Data

Speakly may process app version, device model, operating system version, locale, network status, crash logs, diagnostic data, performance data, and error logs. This data helps improve reliability, security, compatibility, and support.

3.9 Settings and Preferences

Speakly may store app language, source and target languages, favorite languages, downloaded languages, offline mode settings, voice settings, display settings, font size, volume settings, autoplay settings, and related preferences.

3.10 Feedback and Support Data

If you submit feedback, Speakly may collect the feedback title, issue type, details, contact email if provided, and relevant app or device information. This is used to respond to support requests and improve the app.

4. How We Use Information

7. Local Storage and Cloud Sync

Speakly stores certain data locally on your device, such as settings, preferences, cached translations, translation history, downloaded languages, offline resources, and quota-related data. Speakly may also sync certain account-related information, settings, translation history, subscription status, and cloud-enabled data through cloud services when cloud sync is enabled or required for a feature. Local data may remain on your device until you delete it, clear app data, remove downloaded languages, clear history, sign out, or uninstall the app. Cloud-synced data may remain until account deletion or a valid deletion request is processed, subject to legal and operational requirements.

8. Offline Mode and Cache

Offline mode may use downloaded language resources, cached translations, or on-device translation tools. Offline processing may reduce the need to send data online for certain features, but not all features are available offline. When online, Speakly may use online translation-related services, including Azure and Google, to improve availability, speed, or quality.

9. Third-Party Services

Speakly may use third-party services such as Azure, Google, Firebase Analytics, Firebase Crashlytics, Firebase Authentication, RevenueCat, Apple App Store, Google Play, speech recognition providers, text recognition providers, translation providers, cloud infrastructure, and diagnostic tools. These providers may process data according to their own privacy policies and terms. Speakly uses them only as needed to provide, secure, analyze, maintain, or improve the app.

10. Analytics and Diagnostics

Speakly may use Firebase Analytics, Firebase Crashlytics, and similar diagnostic tools to understand app usage, crashes, errors, performance issues, and reliability problems. Analytics and diagnostics may include app version, device type, operating system, feature usage, crash traces, error logs, and performance data. This information is used to improve the app and is not sold.

11. Sharing of Information

Speakly does not sell your personal information. We may share or process information with service providers only as needed for translation, speech recognition, text recognition, authentication, subscription management, analytics, crash reporting, cloud sync, support, security, legal compliance, or fraud prevention.

12. International Processing

Some service providers may process or store data in countries outside your country of residence. Data protection laws in those countries may differ from your local laws. We aim to use reputable providers with appropriate technical and organizational safeguards.

13. Data Retention

We retain information only for as long as reasonably necessary for the purposes described in this policy, including providing the app, maintaining accounts, enforcing quotas, managing subscriptions, supporting users, improving reliability, preventing abuse, complying with law, and resolving disputes. Local data may remain on your device until deleted by you. Cloud or account-related data may be retained until account deletion or valid deletion request, unless retention is required for legal, billing, security, fraud-prevention, or operational reasons.

14. Account Deletion and Data Deletion

If account deletion is available in the app, you may request deletion through the app or by contacting speakly.sp@gmail.com. Deletion may remove or disable access to profile information, cloud-synced settings, account-linked translation history, and other account data. Some information may be retained where necessary for legal compliance, billing records, fraud prevention, security, dispute resolution, backups, or legitimate operational needs. Deleting an account does not cancel an active Apple App Store or Google Play subscription. You must cancel subscriptions through the relevant app store account settings.

15. Security

We use reasonable technical and organizational measures to protect information, including authentication systems, secure storage where appropriate, access controls, service-provider security measures, and diagnostic monitoring. No app, network, or storage system is completely secure. You should avoid entering highly sensitive information into Speakly unless necessary and understood by you.

16. Sensitive Information

You should avoid entering passwords, payment card details, national ID numbers, passport details, medical records, financial secrets, legal secrets, confidential business information, or highly private information into Speakly unless you understand that the information may be processed by translation, speech, OCR, analytics, cloud, or other relevant services.

17. Children

Speakly is not intended to knowingly collect personal information from children below the minimum age required by applicable law without appropriate consent. If you believe a child has provided personal information without authorization, contact us so we can take appropriate action.

18. Your Privacy Rights

Depending on your location, you may have rights to access, correct, delete, restrict, object to processing, withdraw consent, or request a copy of your personal information. To exercise these rights, contact speakly.sp@gmail.com. We may need to verify your identity before responding to a request.

19. Marketing Communications

If you provide your email for support or feedback, we may use it to respond to that request. We will not send direct marketing communications unless permitted by law or with your consent. If marketing emails are introduced in the future, you will be provided with a way to opt out where required.

20. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If changes are significant, we may notify you through the app, website, email, or other reasonable means. Continued use of Speakly after the effective date of an updated Privacy Policy means you acknowledge the updated policy.
